Letter of demand
A letter of demand is a letter requesting that a person reimburse you and what that reimbursement is for. This is usually the first step in recovering a debt that is owed to you.
There are laws that apply to requests for repayments of debts or consumer credit. When you contact an individual or company that owes you money, you must be careful that you do not 'harass or intimidate' the person.
If you have not received a response to your letter of demand, you can send another letter or institute legal proceedings. In minor debt matters, known as 'small claims,' you can do this by lodging a statement of claim in the Magistrate's court in your state or territory.
Here are the steps to prepare a letter of demand in Australia:
Identify the debtor: Gather information about the person or company that owes you money, including their name, address, and contact information.
State the amount owed: Clearly state the amount owed and provide details of the debt, including the date it was incurred, the goods or services provided, and any relevant agreements or contracts.
Specify a deadline: Set a deadline for payment and indicate that legal action will be taken if the debt is not paid by that date. The deadline should give the debtor enough time to respond and make payment, usually between 7-14 days.
Send the letter: Send the letter of demand by registered mail or email, and keep a copy for your records.
Follow up: If the debtor does not respond or make payment by the deadline, you may need to take legal action, such as filing a claim in court or engaging a debt collection agency.
